DISPONIBILITÉ DES RÉCOMPENSES</h3><p>Les Récompenses sont offertes sur une base rotative et peuvent varier dans le temps.</p><p>La nature, la quantité et la disponibilité des Récompenses sont déterminées à la seule discrétion de Bell, selon les paramètres établis pour le Programme.</p><p>Certaines Récompenses peuvent être limitées à des participants situés dans ou associés à certaines régions. L’accès à une Récompense particulière peut dépendre notamment de la localisation du compte du participant ou de la configuration applicable au moment de la participation.</p><p>Les Récompenses sont offertes en quantité limitée et jusqu’à épuisement. Bell ne garantit pas la disponibilité d’une Récompense particulière à un moment donné.</p><p>Bell se réserve le droit de modifier, d’ajouter ou de retirer toute Récompense à tout moment, sans préavis.</p><h3>5. SÉLECTION ET CONFIRMATION</h3><p>La sélection des participants pouvant recevoir une Récompense est effectuée instantanément au moyen d’un système automatisé intégré au Programme.</p><p>Si un participant est sélectionné pour recevoir une Récompense, il en sera informé immédiatement dans l’interface du Programme.</p><p>Afin de confirmer son admissibilité et de réclamer la Récompense, le participant doit remplir le formulaire de confirmation requis immédiatement après avoir été avisé de sa sélection. À défaut de compléter le formulaire conformément aux instructions fournies, la Récompense sera automatiquement annulée et remise en circulation, sans compensation.</p><p>Bell se réserve le droit de vérifier l’admissibilité et l’identité du participant sélectionné avant l’attribution d’une Récompense. Si un participant ne satisfait pas aux exigences du présent Règlement ou omet de se conformer aux instructions fournies, la Récompense pourra être annulée.</p><h3>6. CONDITIONS DES RÉCOMPENSES</h3><p>Les Récompenses sont offertes telles quelles et doivent être acceptées telles qu’attribuées.</p><p>Les Récompenses n’ont aucune valeur monétaire, ne sont ni transférables ni échangeables contre de l’argent, et ne peuvent faire l’objet d’aucune substitution par le participant.</p><p>Une Récompense ne peut être utilisée que pour l’événement ou l’avantage auquel elle se rattache et selon les conditions applicables à cet événement ou avantage.</p><p>Les Récompenses peuvent être assujetties aux modalités et conditions additionnelles imposées par des tiers, notamment les organisateurs d’événements ou les fournisseurs de services. Le participant accepte de se conformer à ces conditions.</p><p>Tout frais, dépense ou coût non expressément inclus dans la description de la Récompense demeure à la charge exclusive du participant.</p><p>Bell se réserve le droit, à sa seule discrétion, de substituer une Récompense par une autre de valeur comparable si une Récompense devient indisponible pour des raisons hors de son contrôle raisonnable.</p><p>Bell ne pourra être tenue responsable si un événement est modifié, reporté ou annulé par un tiers.</p><h3>7. LIMITATION DE RESPONSABILITÉ</h3><p>En participant au Programme, le participant accepte de dégager Bell, ses sociétés affiliées, ses représentants, employés, mandataires et partenaires de toute responsabilité relativement à sa participation au Programme ou à l’acceptation, l’utilisation ou la mauvaise utilisation d’une Récompense.</p><p>Sans limiter la généralité de ce qui précède, Bell ne pourra être tenue responsable :</p><ul><li>de toute défaillance technique, erreur de système, interruption de service ou problème lié au fonctionnement de l’application MyBell ou du Programme ;</li><li>de toute participation transmise en retard, perdue, incomplète, corrompue ou non reçue pour quelque raison que ce soit ;</li><li>de toute erreur humaine ou technique pouvant survenir dans l’administration du Programme ;</li><li>de toute tentative d’intervention non autorisée ou de toute activité frauduleuse ;</li><li>de toute modification, report ou annulation d’un événement lié à une Récompense ;</li><li>de tout dommage, perte ou préjudice découlant de la participation au Programme ou de l’utilisation d’une Récompense.</li></ul><p>Le participant reconnaît que le Programme est fourni « tel quel » et « selon la disponibilité », sans garantie d’aucune sorte, expresse ou implicite.</p><h3>8. MODIFICATION, SUSPENSION OU FIN DU PROGRAMME</h3><p>Bell se réserve le droit, à sa seule discrétion et sans préavis, de modifier, suspendre ou mettre fin au Programme, en tout ou en partie, à tout moment.</p><p>Sans limiter la portée de ce qui précède, Bell peut notamment :</p><ul><li>modifier les paramètres du Programme ;</li><li>ajuster les limites de participation ;</li><li>ajouter, retirer ou remplacer des Récompenses ;</li><li>modifier les modalités d’attribution ou de confirmation ;</li><li>suspendre temporairement l’accès au Programme pour des raisons techniques, opérationnelles ou commerciales.</li></ul><p>Bell se réserve également le droit d’annuler toute participation ou Récompense si des circonstances imprévues, des problèmes techniques, des erreurs administratives ou toute autre situation hors de son contrôle raisonnable compromettent l’intégrité ou le bon fonctionnement du Programme.</p><p>Aucune modification, suspension ou fin du Programme ne donnera lieu à une indemnité ou compensation de quelque nature que ce soit.</p><h3>9. CONDITIONS GÉNÉRALES</h3><h4>10.1 Décisions</h4><p>Toute décision de Bell relativement au Programme, incluant notamment l’admissibilité des participants, la validité des participations et l’attribution des Récompenses, est finale et sans appel.</p><h4>10.2 Vérification</h4><p>Toute participation est sujette à vérification par Bell. Toute participation qui est incomplète, illisible, frauduleuse, transmise en retard, ou autrement non conforme au présent Règlement pourra être annulée.</p><p>Bell se réserve le droit d’exiger toute preuve jugée raisonnablement nécessaire afin de confirmer l’admissibilité d’un participant ou la validité d’une participation avant l’attribution d’une Récompense.</p><h4>10.3 Disqualification</h4><p>Bell se réserve le droit, à sa seule discrétion, de disqualifier toute personne qui :</p><ul><li>contrevient au présent Règlement ;</li><li>fournit des renseignements faux ou trompeurs ;</li><li>tente de contourner les limites de participation ;</li><li>altère ou tente d’altérer le fonctionnement du Programme ;</li><li>utilise des moyens automatisés ou frauduleux.</li></ul><h4>10.4 Intégrité du Programme</h4><p>Toute tentative visant à compromettre le fonctionnement légitime du Programme peut constituer une violation des lois applicables. Bell se réserve le droit d’exercer tout recours permis par la loi.</p><h4>10.5 Fonctionnement technique</h4><p>Bell ne garantit pas que le Programme sera accessible ou fonctionnera sans interruption ou sans erreur.</p><p>Bell ne pourra être tenue responsable de toute défaillance technique, congestion réseau, erreur de transmission, panne de système ou tout autre événement hors de son contrôle raisonnable pouvant affecter le fonctionnement du Programme.</p><h4>10.6 Divisibilité</h4><p>Si une disposition du présent Règlement est jugée invalide ou inexécutable, les autres dispositions demeureront en vigueur dans toute la mesure permise par la loi.</p><h4>10.7 Langue</h4><p>En cas de divergence entre la version française et toute autre version du présent Règlement, la version française prévaudra.</p><h4>10.8 Genre</h4><p>Le genre masculin est utilisé sans discrimination et dans le seul but d’alléger le texte.</p><h4>10.9 Lois applicables</h4><p>Le Programme est régi par les lois applicables au Canada ainsi que celles de la province ou du territoire de résidence du participant, sans égard aux règles relatives aux conflits de lois.</p><h4>10.10 Absence de droit acquis</h4><p>La participation au Programme ne confère aucun droit acquis ou contractuel à l’obtention d’une Récompense.
